What should you do to make a bad-faith insurance claim?

You were in a car crash, and you were immediately sent to the hospital. You took time to recover, but you also made sure that your insurance agent was aware of the situation.

You carry underinsured or uninsured motorist coverage because of the concern that other drivers won't have the insurance they need. This time, that worked in your favor, because the driver wasn't insured. The only problem is that your insurance company isn't returning your calls, and every call you get seems to be dropped before you get any answers.

You could be a victim of a bad-faith insurance claim

You think that your insurance agency doesn't want to pay out, and even after saying as much to the agent, nothing has happened. Now, you want to start a bad-faith insurance claim.

To do this, you'll first want to make sure you review your insurance contract to determine if enough time has passed or if your benefits have been restricted inappropriately. If you believe so, begin to keep track of your claim and keep evidence and key documents together. You'll want to have this information ready for your attorney if you plan to file a lawsuit against the insurance company.

Before you turn to a lawsuit, remember that you can make a demand that the company resolves your claim. You can send a written demand letter, which is simple for your attorney to draw up, and detail your claim. The insurer then has up to 60 days to pay your claim. If they don't, then you can pursue a lawsuit.
